Personal Injury Protection (PIP) is a mandatory coverage in some states, including Oregon. It provides coverage for car accidents, truck accidents, accidents where you are a passenger in someone else’s car, bicycle accidents and even pedestrian accidents. Unfortunately, in Oregon PIP coverage is not required for motorcycle accidents.

In Oregon, PIP coverage of at least $15,000 pursuant to ORS 742.520 and ORS 742.524. PIP in Oregon provides coverage for medical bills, lost wages, funeral expenses, child care, and can even pay for help with household chores such as cleaning or cooking – as long as the initial injury occurred because of the car accident. PIP coverage is only available up to one year after the accident.

In Oregon, PIP is subrogable, meaning that your insurance carrier will pay for your loss, regardless of liability, and then recover (or subrogate) what it paid from the liable party’s insurance carrier. This generally leaves the claimant/insured in a better financial position, because his or her medical bills are paid for, and the insurance carriers have to figure out which provider has to pay the expenses.

PIP also covers other passengers in the vehicle and pedestrians or bicyclist affected by the vehicle. The basic coverage is without regard to liability. In other words, even if you caused the accident, your insurance is required to pay for medicals up to a minimum of $15,000 for the first year.

PIP can be a great financial source to tap into if you are involved in an accident – even if it was your fault. However, there are exceptions: For wage compensation, you must be absent from work for at least 14 days before PIP will begin paying for lost wages. Also, insurance companies will often require you to attend a medical examination. If the doctor concludes your injuries have healed or that the medical treatment you are receiving is not reasonable or necessary, the insurance company will stop paying additional medical bills.
